AERFEX Terms of Service

Important: This is a business-drafting framework, not jurisdiction-specific legal advice. Bahamian counsel and relevant U.S. logistics/customs professionals must review these Terms before launch.

These Terms govern use of the AERFEX website, customer account, freight-forwarding, receiving, purchasing assistance, delivery, return and related logistics services.

1. Agreement

By creating an account, submitting a shipment, requesting a service, or using the website, the customer agrees to these Terms and incorporated policies.

2. Eligibility

Customers must provide accurate identity, contact, shipment, purchase and customs information and must have legal authority to ship the goods submitted.

3. Customer Account

Customers are responsible for maintaining account security and using their assigned AERFEX customer ID correctly.

4. Receiving Address

The Florida receiving address is provided solely for approved AERFEX services. It may not be used for unlawful activity, residency, financial accounts, identity documents or other unauthorized purposes.

5. Package Identification

Customers must follow AERFEX addressing and pre-alert requirements. Unidentified packages may be delayed and may incur reasonable research, handling or storage charges where disclosed by policy.

6. Accurate Declarations

Customers must provide truthful invoices, values, descriptions, quantities and supporting documentation. AERFEX may reject shipments with missing, suspicious or inaccurate information.

7. Restricted Goods

Customers may not ship prohibited or restricted goods except where AERFEX expressly permits them and all legal/carrier requirements are satisfied. Reference: /prohibited-restricted-items.

8. Customs

Customs classification, duty, VAT, levies, processing fees and government assessments are determined under applicable law and/or by relevant authorities. Estimates provided by AERFEX are not guarantees.

9. Rates

Rates and fees are published or quoted by AERFEX and may vary based on weight, dimensions, service, destination, storage, handling, customs treatment, carrier costs and other applicable factors.

10. Chargeable Weight

AERFEX may use actual, dimensional or other applicable chargeable weight according to the published service policy.

11. Bundling/Repacking

Bundling, consolidation or repacking is not guaranteed. AERFEX may refuse to combine goods where doing so could create safety, customs, carrier, documentation or damage risks.

12. Storage

Packages are held free of charge for the first 30 days after arrival at the Florida receiving address. A storage fee of $1.00 per day applies after the free period, and current fees are shown in your account. If a package remains uncollected, unpaid or otherwise unactioned for 90 days after arrival, AERFEX will make reasonable efforts to contact the customer at the account email and phone number on file. If the customer does not respond or arrange collection, payment or return within 14 days of that notice, AERFEX may treat the package as abandoned and, at its discretion and to the extent permitted by law, return it to the original sender, donate it, or otherwise dispose of it. AERFEX is not liable for the value of any package disposed of under this section after the notice period has passed.

13. Payments

Amounts due must be paid using accepted methods before release/delivery where required.

14. Shop For Me

Product availability and retailer pricing may change. AERFEX will not purchase until required customer approval/payment is received. Retailer warranties, returns and product quality remain subject to the retailer/manufacturer.

15. Returns

AERFEX's role is limited to the logistics service purchased. AERFEX does not guarantee that a merchant will accept a return, issue a refund or honor a warranty.

16. Delivery

Delivery availability, service areas and windows are subject to published terms. Customers must provide a safe and accurate delivery location and authorized recipient information.

17. Inspection

To the extent permitted by law and applicable carrier/customs requirements, packages may be inspected for identification, safety, customs, security, damage prevention or service compliance.

18. Delays

International logistics may be affected by customs, weather, carriers, ports, aviation, vessels, inspections, government action, force majeure and other events outside AERFEX's reasonable control. Delivery dates are estimates unless expressly stated otherwise in writing.

19. Loss or Damage

AERFEX takes reasonable care of every package but does not manufacture, inspect or guarantee the condition of goods packed by a retailer or a customer. Unless a customer has purchased additional declared-value coverage for a specific shipment, AERFEX's liability for the loss of, or damage to, a package while in AERFEX's care is limited to the lesser of (a) the amount the customer paid AERFEX for shipping and handling that package, or (b) $100.00 per package. Where additional declared-value coverage was purchased and paid for at the time of shipment, AERFEX's liability is limited to the declared value stated at that time, less applicable deductibles.

AERFEX is not liable for loss or damage caused by the original packaging or retailer, customs inspection or seizure, carrier handling once a package has left AERFEX's custody, items concealed inside other items and not declared, prohibited or restricted items shipped in violation of these Terms, or events outside AERFEX's reasonable control (see Section 18). AERFEX is not liable for indirect, incidental or consequential losses, including lost profits or loss of use.

Claims for loss or visible damage must be submitted in writing through the customer's account or to info@aerfex.com within 14 days of delivery (or, for a package that never arrives, within 14 days of the expected delivery date), with supporting photos and documentation. Claims submitted after this window may be declined.

20. Customer Indemnity

The customer agrees to indemnify and hold AERFEX, its officers, employees and agents harmless from any claim, loss, fine, liability or expense (including reasonable legal fees) arising from: the customer's breach of these Terms; inaccurate, incomplete or misleading information, invoices or declarations the customer provides; goods that are prohibited, restricted, counterfeit, mislabeled or shipped without required approval or documentation; the customer's violation of applicable law; or a third party's claim relating to goods the customer shipped, purchased or had delivered through AERFEX. This indemnity does not extend to loss or expense caused by AERFEX's own gross negligence or willful misconduct.

21. Service Refusal

AERFEX may refuse, suspend or terminate service for unlawful activity, fraud, nonpayment, abusive conduct, unsafe goods, policy violations or other legitimate operational/security reasons.

22. Intellectual Property

AERFEX names, logos, website content and proprietary materials may not be used without authorization.

23. Privacy

Personal information is handled under the AERFEX Privacy Policy.

24. Changes

AERFEX may update these Terms prospectively. Material changes should be communicated as required by applicable law.

25. Governing Law

These Terms are governed by the laws of the Commonwealth of The Bahamas, without regard to conflict-of-law principles. Any dispute arising from these Terms or AERFEX's services that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Grand Bahama, The Bahamas.
